仲裁协议

是指双方当事人自愿将他们之间已经发生或者可能发生的争议提交仲裁解决的协议。从性质上看，仲裁协议是一种合同。它必须建立在双方当事人自愿、平等和协商一致的基础上。仲裁协议是双方当事人共同的意思表示，是他们同意将争议提交仲裁的一种书面形式。所以说仲裁协议是一种合同。从形式上看，仲裁协议是一种书面协议。一般的合同可以是书面形式也可以是口头形式，仲裁协议的形式具有特殊性，这种特殊性就是要求要有书面形式。对此仲裁法有明确规定。《仲裁法》第16条规定，仲裁协议包括合同中订立的仲裁条款和以其他书面方式在纠纷发生前或者纠纷发生后达成的请求仲裁的协议。从仲裁法的这一规定可以看出，我国只承认书面仲裁协议的法律效力，以口头方式订立的仲裁协议不受法律保护。当事人以口头仲裁协议为依据申请仲裁的，仲裁机构不予受理。
