涉外案件规范办理从翻译制度抓起

随着我国对外开放程度的不断深入，外国人犯罪现象呈现频发态势。修改后刑诉法规定，外国人犯罪案件由基层检察院管辖，给基层检察院提出了新的挑战。为依法规范涉外刑事案件的办理，切实维护外籍当事人的合法权益，天津市河西区检察院结合办案实际，制定了办理涉外刑事案件有关程序的规定，初步形成了办理外国人犯罪案件规范化机制。其中，重点规范了书证、法律文书的中外文译本的翻译工作。同时，该院充分利用当地资源，建立了第三方涉外刑事案件翻译人才服务平台。

该院在调研中发现，外国人犯罪案件当事人或其家属所聘请的翻译人员素质良莠不齐，有的甚至没有翻译资质，或不具备法律常识，对权利和责任不明，无法确保办案质量，可能影响诉讼的公正、公平。为彻底解决这一问题，该院摸索创新机制，与天津外国语大学翻译中心签订了《关于建立办理涉外刑事案件合作机制的议定书》，从多个方面入手建立了具有较高专业水平的第三方翻译人才服务平台，以购买服务的方式为办案活动和当事人及其家属提供翻译服务。

　　一是确定翻译人员资质

诉讼活动中翻译人员工作性质特殊，必须具备执业资质。在这方面，该院限定所聘请翻译必须是最高人民检察院外事局、本市或区政府外事部门认可的专业翻译人员，或驻区高校正式的翻译服务人员或专业教师，同时依法接受涉案人员国籍国驻华使领馆外交人员和工作人员为涉案人员个人提供翻译服务。

　　二是对翻译人员进行必要培训

根据涉案人员语言成分复杂的特点，该院发挥“检校共建”的优势，与驻区高校合作搭建翻译人员应急性储备资源库。由检察机关选派的专家型诉讼人才、高校选派的语言教学专业教师，借助外国语大学的涉外法律专业教学平台对备选人员进行系统培训。例如，对日常工作中所涉及的常用法律法规、诉讼专业词汇、刑事诉讼基本流程等问题进行专题培训，确保翻译人员业务素质过硬，以适应诉讼活动的各种需要;同时，本院青年干警也同步参加培训，从中选拔考核成绩优秀的干警承办涉外案件，打造业务过硬的公诉队伍。

　　三是对翻译人员执业活动进行监督

参加诉讼活动的翻译人员必须自觉遵守诉讼规定，同时也享有必要的权利保障。该院结合工作实际制定了《翻译人员须知》，并在第一次聘请翻译人员参与刑事诉讼时交其阅后签字附卷。此举从制度上首次明确告知翻译人员在参与刑事诉讼过程中所享有的基本权利、所必须承担的诉讼义务。以书面形式记录翻译人员对权利义务的认知，在充分保障其合法权益的同时，也为日后因其个人原因造成翻译事故影响办案质量而受到追究时提供证据支持。

　　四是规范第三方涉外刑事案件翻译人才服务平台向办案机关和诉讼当事人及其家属提供服务的途径和收费依据

当案件当事人及其家属不能使用中文与办案人员交流或阅读诉讼文书、证据文字，并且国籍国驻华使领馆不能为其提供翻译人员的时候，可向服务平台寻求帮助，费用自理;检察机关侦监、公诉和其他业务部门因交流障碍需要协助的，经内部审批程序向服务平台寻求帮助，所需费用由业务经费列支。该平台同时向律师提供服务。

　　五是规定应当聘请其他翻译人员的几种情形

同一案件在不同的刑事诉讼阶段，应当由不同的翻译人员提供口译服务;同一案件应当由不同的翻译人员分别提供口译和笔译服务;同一案件应当由不同的翻译人员为外国籍当事人在接受探视、会见和与外界通信时提供翻译服务。这种翻译替换机制可以有效避免因翻译人员恶意行为而引发的办案事故，确保办案安全和案件质量。

通过规范涉外刑事案件办案程序，为基层检察机关办理涉外刑事案件提供了规范化的经验。特别是第三方诉讼翻译服务平台的建立，有效地规范了当前翻译市场的混乱状况，更好地满足了办案人员、涉案人员家属的翻译需求，对外展示了检察机关的良好形象，有力地提升了司法公信力。
