翻译抄袭翻译？两专家打侵权官司

两位著名考试辅导专家，先后出了两套教辅资料，都是对同一套英文教材进行翻译；结果，翻译作品出现一些相似之处。后翻译作品对前翻译作品是否构成侵权？

两套英语辅导书侵权之争

原告张某是我国外语界著名学者、考试辅导专家，出版了英语著作100余部；被告马某是我国著名英语词汇记忆专家，出版的词汇类、翻译类作品非常畅销。

张某称，其花费大量心血完成了著作《大学英语专业综合教程学习指南2》和《高级英语学习指南二》。而马某未经许可，在其后来主编的《英语专业综合教程课文辅导大全2》、《高级英语课文辅导大全2》两本书中进行抄袭剽窃，遂于去年起诉至法院，要求马某承担赔偿责任。

对此，马某辩称，自己并未抄袭张某的作品，两本书均是自己及团队独立创作完成。因辅导书均是针对大学英语教程里的英语原文进行的翻译，存在相似之处在所难免，并不构成抄袭，请求法院驳回原告的诉讼请求。

开庭7天 法官当庭翻书比对

今年3月，此案开庭时，原被告为了论证自己的观点，各自提交著作2本，及原教材2本。6本著作共计2266页253万字，比对工作非常复杂。合议庭开始想委托给专业机构进行鉴定，但发现他们也没有鉴定翻译作品的经验；且涉案图书字数太多，如按字数收取鉴定费费用高达10万元，太过昂贵。

面对僵局，法官们只好亲自上阵：每天9时到晚上7时，当庭对每一篇文章进行比对，历时7天，终于明确了涉案图书中相同、相似、不同部分。原被告双方对此心服口服，没有异议，在法官的“撮合”下，双方最终达成和解，被告即时履行了和解协议。

据悉，此案也是该院知识产权庭受理的首例涉及翻译作品抄袭的案件。
