规范诉讼翻译解决司法实践难题

刑事诉讼翻译人员作为独立的诉讼参与人，对于查清案件事实、维护当事人权利具有重要作用。目前我国相关法律法规对刑事诉讼翻译活动缺乏明确规定，给司法实践带来一定难题。天津市检察机关结合工作实际，出台规范性文件，规范刑事诉讼翻译活动，解决了司法实践中长期存在的老大难问题。

一、当前刑事诉讼翻译工作存在五大问题。经深入了解，当前刑事诉讼翻译活动存在的主要问题有:一是翻译人员权利义务不明。翻译人员在参与刑事诉讼过程中应享有哪些权利、义务，法律和相关司法解释没有明确规定，司法实务中缺乏统一认识。二是翻译行为缺乏规范。办案人员在聘请翻译人员时缺乏资格审查和权利义务告知程序，个别翻译人员行为有失客观中立，从而影响到刑事诉讼的顺利进行。三是聘请翻译渠道不畅。司法实践中，能够翻译外语、聋哑手语和少数民族语言且能接受司法机关聘请参与刑事诉讼的人员较少。尤其是在刑诉法修改后，外国人犯罪案件管辖权下移，基层检察院需要聘请翻译的案件增多，翻译人员聘请渠道缺乏，严重影响办案效率。四是翻译人员资质参差不齐。我国没有成立专门的翻译人员培训机构，缺乏翻译人员的资格考试、资质评估制度，翻译人员的翻译能力、翻译水平、法律素养等无法得到评估。加之司法实践中存在聘请随意、把关不严现象，导致参与刑事诉讼的翻译人员素质参差不齐。五是翻译质量亟须提高。翻译人员资质参差不齐，诉讼过程中又缺乏对翻译活动的监督，相关救济程序也不完善，当出现误译或者漏译时，很可能影响到案件最终的定罪量刑。

二、制定聘任翻译人员参与刑事诉讼规范性文件。为解决上述问题，天津市检察院查阅了天津市近年来外国人犯罪、少数民族人员犯罪、聋哑人犯罪等数据统计情况，向各基层院了解聘请各类语言翻译情况，组织干警对相关问题进行理论研讨等，在此基础上，出台了《天津市人民检察院关于聘任翻译人员参与刑事诉讼的暂行规定》(以下简称《规定》)。

一是明确翻译人员权利义务。翻译人员权利义务对应着翻译人员的诉讼地位与法律责任，是规范翻译活动的基础性工作。《规定》首先界定了刑事诉讼翻译人员的概念，在此基础上申明了其权利义务。

二是规范翻译人员参与程序。《规定》对聘请翻译的情形范围、翻译人员的回避制度、权利义务告知制度、翻译材料的签名确认程序、翻译活动全程同步录音录像制度、诉讼当事人提出异议的救济程序等作出了明确规定。

三是加强翻译人员监督管理。要求翻译人员在参与刑事诉讼活动前必须在权利义务和保密责任须知上签字。必要时，对翻译过程全程同步录音录像。翻译人员违反法定义务的，要予以解聘，并依法做出相应处理。

三、建立人才库对检务翻译进行科学管理。根据天津的区域特点，在充分听取各基层院意见的基础上，天津市检察院通过与天津外国语大学、天津聋人学校、民族学校等有关单位协商，经推荐审核确定了35名检务翻译，制定了检务翻译人才库名录，形成了全市统一的翻译人才库，实现了英语、日语、俄语等外国语言，蒙语、维吾尔语、等少数民族语言以及聋哑手语等常见语种的全覆盖。

一是统一翻译人员选聘程序。天津市院制发聘请决定，确定检务翻译人才库人员名单。天津市各级检察机关在执法办案过程中需要聘请翻译的从人才库中随机选聘。统一翻译人员选聘程序，一则有利于集约化管理，节省司法成本，提高办案效率;二则有利于充分发挥检务翻译人才库的优势作用，避免实践中“找熟人”式的不规范情形，减少翻译人员倾向性;三则有利于增强翻译人员的荣誉感，增强其客观公正翻译的自觉性。
二是对检务翻译人才库动态管理。把好入口关，提高了刑事诉讼翻译人员的准入门槛，为确保翻译活动的质量奠定基础。对翻译人员进行年度资格审查，并根据工作需要和实际情况对翻译人才库进行调整和补充，对翻译人员进行业务培训，实现动态管理，以保证检务翻译人才库的人员素质。

三是规范翻译人员的酬劳标准。实践中，翻译人员酬劳标准尺度不一，数额千差万别，不利于规范执法。针对此情况，天津市院对翻译人员参与刑事诉讼活动的酬劳进行合理规范，提供参考标准，明确规定聘用单位应根据翻译种类、翻译工作量及翻译难度确定酬劳，从业务经费中依财务程序支出。(作者单位:天津市人民检察院)
