私译作品扰乱正规译著市场

曾经是“共享主义”产物的图书“私译”行为，正在成为一个商业味极浓的产业。以此谋生的私译者，利用正版原著和正版译著的上市时间差，赚得钵满盆满。据记者了解，“私译”一本30万字的畅销小说，可有数万元的收入，还无需缴税，这甚至比正规译者的收入还要高。而他们的行为对出版业造成致命打击。青年报记者郦亮

“私译”泛滥：一本书可以赚几万

人气动漫高达的新书刚刚在日本发布，网上便出现了中译本。然而这些译本并不属于任何一家正规出版社。

网络的工作人员向青年报记者坦言，这些译本都是他们“私译”的，“正版哪有我们的快？如果你要等正版出来，可能要到明年了！”当然，“私译”的劳动成果不能白送。向指定账户每打3元钱，便能获得网站提供的一个下载密码，便可以读到一本高达新作。

据青年报记者观察，“私译”正在成为一些草根译者谋生的手段。网友“来去用爬”最近就在和几个朋友加紧合译村上春树的新作《没有色彩的多崎作和他的巡礼日子》。

“来去用爬”大学学的是日语，平时有正式工作，翻译只是爱好。但当几年前村上的另一部作品《1Q84》上市，“来去用爬”看到有人抢在正版上市前抢先译出中文本，在网上销售和提供给盗版商，收入颇丰，他觉得或许可以用自己的一技之长赚点钱。

村上这部新作《没有色彩的多崎作和他的巡礼日子》的正版中译本最快也要年底或者明年初上市，“来去用爬”也就盘算着，他们如果能早译出几个月，利用时间差，也许可以很有一番作为。“你知道，国内很多村上拥趸都在盼着早点读到这本书呢！”

以记者了解到的情况，草根译者“私译”一本30万字的畅销小说，可有数万元的收入，还无需缴税，这甚至比正规译者的收入还要高。但日趋商业化的“私译”风潮，着实让出版商头痛不已。

“私译”之害：商业“私译”困扰出版业

据了解，“私译”的情况其实早在多年前《哈利波特》热销的年代便开始了。2007年《哈7》英文版上市，因为中文版要在3个月后才能出版，就有一群按捺不住的“哈迷”开始了疯狂的“私译”，他们每译一个章节，便贴到网上与人分享。2009年丹布朗新作《消失的符号》刚刚上市没多久，“私译”不仅出来了，而且还被人做成精美的PDF，甚至被读者评价，“私译本”的排版比正版还好看。
这些“私译”行为自然都没有经过授权，当时就遭到作者和出版商的强烈抗议。JK罗琳方面直接对中国草根译者表示不满。毕竟“私译”的作品疯传，将直接影响正版的销量。有人甚至估计，如果没有“私译”，正版《哈7》中译本的销量还会增加10万册以上。所以有说法认为出版社遇“私译”如遇“灭顶之灾”。

但耐人寻味的是，当时那些草根译者几乎都没有被惩罚。主要的一点是，这些“私译”不过是草根译者制作的一顿“分享大餐”，他们从中并没有获得收益，所以也就不会被追究法律责任。

可是现在，“来去用爬”这类译者显然已经把“私译”推向了一个新的高度，“私译”不仅是展示才华的途径，也是谋生的手段。专业从事版权法律事务的吴律师认为，根据我国著作权法第12条规定，翻译者应首先获得原著作权人的许可。如果“私译”只是为了分享，属于22条规定的合理使用，则不违法，如果从中牟利则属于非法所得。而网站方面利用网友私译牟利，也属于违法。
