宜设立刑事诉讼翻译人才库

刑事诉讼的翻译可分为哑语翻译、外语翻译、少数民族语言翻译三大类。刑诉法关于翻译的规定较为简略，司法实践中常出现因翻译准确性较低而影响对犯罪嫌疑人主观故意的认定和客观行为的判定，完善刑事诉讼翻译制度已成为当务之急。
一、完善诉讼翻译的实体性规则。
第一，完善诉讼翻译人的任职资格。现有翻译人员往往由聋哑学校教师、懂少数民族语言的政法干警、外文翻译社的职员等充任，翻译水平参差不齐。因此，在省或市行政区范围内有必要设立翻译人才库，将具备一定法律知识、翻译能力达到一定标准的翻译人才录入该人才库。
第二，完善诉讼翻译人员回避制度。翻译人员的回避，宜参照审判、检察、侦查人员的回避规定执行。翻译人员可以连续为侦查、检察、审判三个阶段作翻译，担任过本案某诉讼阶段翻译人员的人则不能担任本案案件的承办人员，但可以为本案的其他诉讼阶段再次翻译。
第三，部分疑难案件实行两人翻译规定。目前司法实践中，翻译大多为一人翻译，由一名翻译对简易案件进行翻译在法律上是可行的。但一人翻译毕竟缺少监督，特别是在语义有歧义的情况下，两名翻译人员可以通过协商增强翻译的准确性。被告人不认罪或证据链不完整等疑难案件应需两人共同翻译，或一人翻译同时另一人担任复核任务。
二、完善诉讼翻译的有关程序性规则。
第一，规范翻译人员的选任程序。目前实践中挑选翻译人员的工作基本由办案人员进行，挑选比较盲目，随意性比较大。设置翻译人才库后，可由承办人提出申请，办案单位审批后向诉讼翻译人才库的主管行政部门提出申请要求，费用由财政予以承担。
第二，实行翻译人员权利义务告知制度。因诉讼翻译涉及到对犯罪嫌疑人、被告人刑事责任的追究，也涉及到被害人的切身利益，翻译人员必须谨慎翻译。而翻译前告知翻译人员法定的权利义务显得尤为必要。翻译人员的法定权利有:1.翻译人员为正确翻译，有权了解同翻译内容有关的案件情况;2.有权查阅记载其翻译内容的笔录、同步录音录像，并享有就记录的错漏提出异议并修改的权利;3.有根据法律规定申请回避的权利;4.有获得报酬的权利。翻译人员的法定义务有:1.应当按语言的原意进行翻译，不得隐瞒、歪曲或伪造翻译内容;2.根据法律规定可依法被决定回避;3.有保守国家机密、当事人有关隐私的义务;4.查阅记载其翻译内容的笔录、同步录音录像后有签名的义务;5.有依法接受司法机关复核、质询的义务;6.有出庭作证的义务。
第三，完善翻译程序的部分细节性规定。在遇有诉讼翻译人参与讯问时，应进行同步录音录像，使翻译人员的翻译有据可查。翻译人员对记录员所作笔录要进行阅看，实行阅看后签名的工作模式。对于部分疑难复杂案件，必要时实行双语记录，做到翻译的文字有据可查。
