马青春就翻译活动谈———重视同步录音录像的价值

在刑事诉讼中，翻译活动是沟通诉讼各方、保证诉讼程序顺利进行的重要环节。但当前刑诉法对刑事诉讼翻译活动尚缺乏明确的规定，导致了实践中存在很多不规范的情形。对此，马青春在《检察日报》上发表文章《翻译活动应同步录像》中指出：

刑事诉讼翻译活动大体可以分为口译和笔译两种。大多数翻译是口头进行的，对聋哑人的手语、哑语翻译还要通过动作、手势、姿态和表情进行。因此刑事诉讼翻译活动具有即时性，用以翻译的语言和动作、表情转瞬即逝。基于这一特点，翻译记录的留存就是一个重大问题，而同步录音录像(聋哑人翻译应进行录像)是解决该问题的有效方式。

刑事诉讼翻译活动同步录音录像具有如下价值：

1. 一是可以促进翻译人员在参与刑事诉讼时恪尽职守，确保翻译内容真实、准确、完整，防止翻译人员隐瞒、歪曲或伪造翻译内容。
2. 二是可以有效排除办案过程中对翻译活动的不当干涉，确保翻译人员基于专业知识和职业素养中立地进行翻译活动。
3. 三是同步录音录像资料可以客观全面地再现翻译现场，便于对翻译工作及其质量进行检查，纠正错误或者疏漏之处。
